Reminder, compliance requirements begin January 1, 2024. The NYC Department of Buildings adopted a new Rule (Section 28-301.1.1 of the NYC Administrative Code added by Local Law 126 of 2021) requiring that all buildings, regardless of height, must have an annual inspection of their public right-of-way facing parapets.

In "Good Faith" - Local Law 97 |
The city has now released a second round of proposed rules on how co-op and condo boards can comply with Local Law 97. The new rules will be welcome news to boards that are worried about the high cost of reducing their buildings’ carbon emissions under the law’s prescribed caps — and the stiff fines they will face for failing to comply, beginning next year.
Most notably, the new rules clarify what constitutes a “good faith” effort by building owners — and how the Department of Buildings (DOB) will use it to mitigate fines for non-compliant buildings. First, boards must prove that they have complied with laws that require energy and water usage benchmarking (Local Law 85), energy audits and retro-commissioning work (Local Law 87), and lighting upgrades and submetering (Local Law 88). If those criteria are met, the board must also meet at least one of an additional six criteria.

New Sidewalk Shed Regulations |
As of September 1, 2023, the Department of Buildings will no longer waive the Work Without a Permit civil penalty for installed permitted sidewalk sheds with an expired permit. Sidewalk shed permits must be properly renewed prior to their expiration date.
This is one of several new regulatory changes related to sidewalk sheds in the City as part of our "Get Sheds Down" plan, to compel building owners to do the work to remove sheds faster, and to improve the pedestrian experience in our City.

Our FL office completes record Recertifications
|
Following the Surfside condo collapse in June of 2021, changes were made to the inspection process and recertification requirements for 2022 and beyond.
The recertification inspection is now required for buildings that are 30 years old, rather than 40, and every 10 years after that. However, any buildings 40 years or older should continue on their established inspection schedule. Buildings located closer to the coastline and greater than three stories high must have a recertification inspection 25 years after being built.
Merritt's recertification reports are utilized by many top Building Owners and Property Managers in Florida. Our reports provide a thorough assessment of key components affecting the overall safety of the property including structural, electrical, roofing, fire life safety, windows, etc. The main purpose of the required inspection and report is to confirm that the building is structurally sound and therefore safe for continued use under the present occupancy.
