YOUR COMPLIANCE "TO-DO" LIST BEFORE 2026

Local Law 95 - Building Energy Efficiency Grade

Local Law 95 requires NYC buildings to display energy efficiency scores and grades that annually benchmark their energy and water consumption. 

 

The deadline to post New York City Local Law 33/95 Building Energy Efficiency Rating labels has been extended to December 31, 2025, with grades made available on December 1st.

Local Law 126 of 2021 - PIPS

Local Law 126 of 2021 requires owners of parking structures to hire a NYS licensed and registered Professional Engineer to inspect the structure at least once every six years and file a report with the DOB documenting the results of the inspection. Included in this law are buildings, or portions of a building, used for parking or storing motor vehicles, including space inside or under a building, as well as open parking garages and enclosed parking garages as defined in the NYC Building Code.

 

DEADLINES

 

Manhattan Community Districts 1, 2, 3, 4, 5, 6, 7: January 1, 2022 - December 31, 2023

Manhattan Community Districts 8, 9, 10, 11, 12 and Brooklyn: January 1, 2024 - December 31, 2025

Bronx, Queens, and Staten Island Community Districts: January 1, 2026 - December 31, 2027

Annual Parapet Wall Inspections

Local Law 126 of 2021 requires that all buildings, regardless of height, must have an annual inspection of their public right-of-way facing parapet. The parapet inspection must be performed by an Engineer, Architect, or NYS-authorized building inspector and is due to be filed annually by December 31st. A report must then be prepared to indicate whether any unsafe conditions were found and identify actions necessary to remedy the unsafe conditions. A penalty fee ranging from $1,250 - $10,000 will be issued by the NYC DOB for failure to provide the required observation report upon request

Florida Milestone Inspection

For buildings three stories or taller, a milestone inspection is required by December 31, 2025, for buildings that reached 30 years of age on or after July 1, 2022 for the purpose of noting any signs of structural deterioration.

INDUSTRY NEWS - New York’s Senate Bill 3799

Open your doors (or neighboring walls) for access.

 

New York’s Senate Bill 3799, which has now been signed by Governor Hochul, is an update to Section 881 of the New York Real Property Actions and Proceedings Law (RPAPL) to provide a legal method of gaining access to a neighboring property for construction purposes when access is denied or delayed. 

With an uptick in requests to review access agreements, our team would like to provide some suggestions on what is reasonable to request for record purposes if a neighboring property is performing work that could affect the structural integrity of your building, especially façade and roof work. An amicable agreement is always best but if the necessary legal steps have to be taken, being prepared is the best course of action. 

It is important for building owners, property managers and board members to request and maintain copies of the following:

 

  • Review the access agreement and confirm it is for the present work only.
  • Review the provided work schedule in order to properly set expectations for tenants and notify them of any disruptions.
  • Request a meeting on site with neighboring building owner, owner rep, architect and contractor to better understand the scope of work and ask any questions.
  • Request the name of the engineer, architect, contractor and any specialty trades involved like asbestos abatement contractor, etc. Also ask for insurance for each company.
  • Perform a survey of the property before work begins in order to properly note repairs required after work at the neighboring property is completed. 
  • Check that the designed protection plan is adequate (if applicable).
